Following stock-transfer, the defendant sought to exercise her preserved Right to Buy. That was refused by Knowsley HT, on the basis that her assured tenancy had been lost by breach of a Suspended Possession Order.
The Court held that the tenancy had ended and the defendant had continued in occupation simply as a tolerated trespasser without the preserved Right to Buy. He granted permission to appeal to the Court of Appeal.

A new report from the Scottish Executive examines the effect of Right to Buy in Scotland and suggests that the scheme has introduced significant pressures on social housing provision in some areas. The review also raises other issues, particularly concerning the increasing representation of the elderly, single parents, and unemployed people among social housing tenants.
Publication of the report has stirred debate on the application of the scheme and the need for greater flexibility to allow for local situations and needs.
