The Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment Order 2005 Scottish SI 322
This further amends the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 2003.
This Order reinstates the requirement for a provider of a housing support service, which is a care service and is paid by a local authority out of grants provided by the Scottish Ministers under the Housing (Scotland) Act 2001 (asp 10), to be registered under the Regulation of Care (Scotland) Act 2001 (asp 8).
It revokes the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment Order (No. 2) 2004, which removed the above requirement for registration under the Regulation of Care (Scotland) Act 2001.
Local Government Ombudsman Patricia Thomas issued a report on her investigation of a complaint, about council housing management and social services for children, against West Lancashire District Council.
Mr S, who is a council tenant, complained about problems in carrying out the installation of a bath to meet the needs of his severely disabled son. Mr S's son died shortly after the complaint was made to the Ombudsman, but Mr S indicated that he wished the investigation to proceed to its conclusion.
The Ombudsman found:
These failures were deemed maladministration causing injustice. Combined, the failures delayed the completion of a satisfactory adaptation until only a few months short of the point when the son was no longer able to benefit from it.
To remedy the injustice, the Council apologised to Mr S and agreed to pay him £250 in recognition of the time spent and trouble caused him in pursuing the complaint.
The Council has also assured the Ombudsman that it will review its procedures, to avoid any similar situations in the future.
