When permission is needed to apply for a Warrant of Possession

This useful summary concerns a decision made in the Court of Appeal on 19 October 2016 which changes the procedure to be followed when a Suspended Possession Order, suspended on terms to do with breach of tenancy or ASB, has been breached.

The Court of Appeal confirmed in Cardiff CC v Lee (Flowers) that an application for permission to issue a Warrant must be made before a Warrant request is made.
