A ruling in the High Court has found that officers at Southwark Council acted with 'civil conspiracy', if not 'criminal conspiracy', when the unlawfully evicted a tenant.
The claimant told the Court that the actions against him by the Council's staff left him 'robbed of his dignity and pride'.
The High Court ruled that the officers actions contravened the Human Rights Act when they evicted the claimant, destroyed his possessions and for a period left him to be street homeless.
The Court ruled that the claimant was unlawfully evicted, as due process was not followed. The original Possession Order had expired at the time when the Council's officers applied for a Warrant to evict.
The open judgement also found that the entire contents of the claimant's home were removed and destroyed. These included his passport, laptop (with hundreds of hours work), personal belongings and furniture.
The Judge also took account of an internal investigation into the circumstances by the Council and that the resulting report was not made available to the Court until the second day of the trial. In his judgement, Judge Thornton stated:
"I am driven to the conclusion that the report was withheld because its contents were so damning of and detrimental to Southwark's defences."
