First Batch of Regulatory Judgements Published

The first batch of 18 Regulatory Judgements have been published.

While the strong engagement process that informs the Regulator's decisions is as established by the HCA and set out in Regulating the Standards, the format of the judgements has been revised to communicate the Regulator's position in a shorter and more transparent way.

The new format also makes the best use of the Regulator's resources and brings the HCA's approach into line with that of economic regulators in other sectors.

Full reports will only be produced when the Regulator's view of a provider's compliance with the economic standards has changed - while the reports themselves are much shorter, predominantly focusing on the material factors that have contributed to the revised grade.

Where the Viability/Governance grade remains unchanged, only the Regulatory Judgement straplines will be published.

As well as publishing strapline only judgements for 13 providers who are currently meeting the Regulator's economic standards, the HCA has prioritised full judgements on five providers that are not - to ensure that they and their stakeholders are clear about the Regulator's position.

While three of the five full judgements published reflect the Regulator's concerns, it remains the case that the vast majority of providers are meeting the standards.

The first five full Regulatory Judgement reports which have been published are - Cestria Community Housing Association, Cosmopolitan Housing Group, Metropolitan Housing Trust, Swan Housing Group, and Wakefield and District Housing Limited.

The Regulator also signalled its intention to seek further assurances from Providers around their non-social housing activities.
